GENERAL

The website www.cosmoprof.co.za (“Website”) is owned and operated by The CosmoProf Foundation, registration number 1996/021749/23 (trading as CosmoProf SA), a company incorporated in the Republic of South Africa for the purpose of marketing, training and distributing professional grade aesthetic products and equipment.

By accessing and using the website www.cosmoprof.co.za (‘Website’) and/or placing any order you (“Customer”) enter into a legally binding contract with Company in terms of which you agree to be bound by the terms and conditions (“Terms”) set out and referred to in herein. Any reference to Terms includes a reference to the Terms and Conditions of Use and to the Company’s Policies including its Privacy Policy.

Where this website is accessed by any person on behalf of a Customer who is a juristic person or trust, the person accessing the website accordingly warrants that he is duly authorised to represent and bind the Customer

Any references herein to male shall include female, singular include plural and vice versa.

The Terms constitute the complete and exclusive agreement between the Company and the Customer (“the Parties”). This agreement supersedes all prior understandings, proposals, agreements, negotiations and discussions between the Parties, whether written or oral and any conditions which the Customer may seek to impose.

The Terms , agreement and the relationship between the Parties are governed by the laws of the Republic of South Africa.

The failure to exercise or enforce any right or provision of the Terms does not constitute a waiver of such right or provision. If any provision of the Terms is found by a court of competent jurisdiction to be invalid (because, for example, such provision is inconsistent with the laws of another jurisdiction) or inapplicable, the Parties nevertheless agree that the court should endeavour to give effect to the Parties’ intentions as reflected in the provision.

These Terms may be updated at any time in the Company’s sole discretion. The Company reserves the right to change the price, formula or specifications of any Product or to discontinue any product without prior notice.

CONSUMER PROTECTION ACT 68 OF 2000

If these Terms (or any contract governed by them) or the Products provided and/or made available on the sold through the Website are regulated by or subject to the Consumer Protection Act, Act No. 68 of 2008, as amended from time to time, it is not intended that a provision of these Terms contravene a provision of that Act or remove any right thereunder.

The Customer’s attention is specifically drawn to clauses that are highlighted or bolded.

DATA PROTECTION

The Company collects and processes personal information from the Customer.

The Company will handle the collection, processing and storage of the Customer’s personal information in accordance with the Company’s privacy policy.

By the Customer disclosing or submitting personal information to the Company you consent to the Company collecting, processing and storing it for the purposes described in the Company’s privacy policy (click here).

The CosmoProf Foundation is a business in the aesthetics industry that sells aesthetic products and equipment.

2. Export restriction

The offering on this website is available to South African clients only.

3. Customer Privacy policy

The CosmoProf Foundation shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). 4. Country of domicile

This website is governed by the laws of South Africa and The CosmoProf Foundation chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 48 Fairland Walk, Cnr. Wilson Street and Beyers Naude Drive, Fairland, Johannesburg.

5. Variation

The CosmoProf Foundation may, in its sole discretion, change this agreement or any part thereof at any time without notice.
